What is Collective Agreement?

What is a collective agreement ?
A “collective agreement” is defined under section 2 of the Industrial Relations Act, 1967 as follows:

“an agreement in writing concluded between an employer or a trade union of employers on the one hand and a trade union of workmen on the other relating to the terms and conditions of employment and work of workmen or concerning relations between such parties”


Therefore, by virtue of the above definition, a collective agreement must take either of the following form:
(i) An agreement between an employer and a trade union of workmen; or
(ii) An agreement between a trade union of employers and a trade union of workmen.


What is collective bargaining?
The term “collective bargaining” is defined under s.2 of the IRA to mean negotiating with a view to the conclusion of a collective agreement.

BONUS

Gawai celebration, which is actually a harvest festival, is celebrated by the Dayak community on the 1st of June every year. For staff of SEB, it is also a much anticipated period of the year because Gawai is associated with staff bonus payment (be it festive or performance driven). The common question from staff to the management is normally "any bonus?" and this year is no different. The question comes about because for several years, payment of staff bonus (after obtaining the board of directors' approval on allocation of annual bonus for staff) had been before Gawai.

For this year, we are pleased to inform that the SEB board of directors have also approved staff bonus allocation based on 2010 performance appraisal during the last Board meeting held on 19/05/2011. Staff from relevant divisions/ departments have been working hard to ensure that payment can be made to eligible staff by the end of this month. We wish to thank each & everyone of them for their hardwork and dedication.

On a personal note & on behalf of the EMB, wishing all "Selamat ari Gawai, Gayu Guru Gerai Nyamai" and have an enjoyable, but safe holiday.

This bonus is paid based on employee performance. Although the bonus was paid, we still adhere to the articles that we fought for in the CA proposal is a contractual bonus of two months’ salary for all employees. Performance appraisal is for annual salary increment. With strong support from all KPPSSBS members, We hope that what we are striving to become a reality.
